Atherton has some of the strictest tree protection ordinances on the Peninsula, designed to preserve the community’s mature trees, estate landscapes, and urban forest canopy. The Town of Atherton carefully regulates tree removal, major pruning, and construction activities that may impact protected or heritage trees. These ordinances help maintain the natural beauty, environmental benefits, and property value that trees provide throughout the community. Proper tree care and ordinance compliance are extremely important because unauthorized tree removal or excessive pruning can result in violations, penalties, replacement requirements, and long-term damage to valuable trees.
Under Atherton’s tree ordinance, many trees may qualify as “heritage trees” depending on the species, size, age, and location of the tree. Protected native oak species such as Coast Live Oaks (Quercus agrifolia), Valley Oaks (Quercus lobata), and Blue Oaks (Quercus douglasii) receive special protection throughout Atherton. In many situations, oak trees measuring 48 inches in circumference (approximately 15.2 inches diameter measured 54 inches above natural grade) may require permits before removal or significant pruning work can take place. Trees located outside the primary buildable area of a property may also qualify as protected heritage trees if they meet specific size requirements.
Atherton also strictly regulates excessive pruning and improper trimming practices. Harmful pruning methods such as topping, lion’s tailing, excessive canopy reduction, and improper branch removal are prohibited because they can create hazardous conditions, weaken tree structure, increase disease risk, and permanently damage the long-term health of the tree. Atherton requires ANSI A300 pruning standards to be followed for protected trees and places significant emphasis on preserving tree health and structural integrity.
Certain tree species are exempt from heritage protection requirements regardless of size, including some Acacia species, Tree of Heaven, Mimosa, and Eucalyptus species. However, determining whether a tree is protected can often be complex because regulations depend on factors such as tree species, location, trunk size, age, buildable area restrictions, and overall tree condition.
